XL Group Add Wrongful Internet Usage Protection to Private Co. EPLI Policies

April 4, 2013

XL Group’s Private Commercial insurance business has added wrongful Internet usage protection to its employment practices liability coverage as part of its management liability package to help employers contend with risks posed by employees’ online activities and social media networking,

XL Group’s management liability package policy is specifically designed for small to mid-size private companies and offers D&O, EPLI, fiduciary and crime coverage on one policy. XL Group’s private commercial D&O coverage includes protection from claims brought by whistleblowers, former board members, bankruptcy trustees and others.

In addition to including wrongful Internet usage protection, the policy’s EPLI coverage addresses claims related to discrimination involving age, sex, race, disability, etc., as well as wrongful termination of employment, sexual harassment, and other employment-related allegations.

Fiduciary coverage provides protection against the mishandling of 401K, pension or other welfare benefit plans. Crime coverage provides protection against incidents of employee theft, robbery, in-transit robbery, computer fraud and credit card fraud from third parties.

“One defamatory email by an employee to even a small group of colleagues can impose considerable liability upon a company. We can also add employees’ use of social networking sites like Facebook and Twitter to a growing list of Internet risks that employers must manage,” explained Bruce Simmons, vice president and product manager in XL Group’s Private Commercial unit. “In fact, with one click of a mouse, the Internet, especially the growing number of social media networks at work, poses a multitude of employment practices risks that employers cannot afford to ignore.”

“This enhancement specifically adds employees’ online and social media activities during or after work hours, on or off company premises to the definition of what is considered a wrongful act in our EPLI policy,” explained Simmons.

XL Group’s Management Liability coverage is available in the US through XL Specialty Insurance Company.
