Is Ebola Compensable Under Workers’ Compensation?

    If a Funeral Home was contacted to pick up a body that had this infection or some other contagious deadly disease, would that employee be protected by Work Comp? How about the person who processes the body for cremation? What if the religion of the deceased does not allow cremation? They are not health care workers, but they very likely would not have the protective equipment necessary to handle this exposure safely. My initial reaction is that this would be covered under workers compensation. To me this meets the test “arising out of and in the course of employment”.

      I believe you are right Crain. I would say that Funeral Homes who know that a body to be picked up died from Ebola would take the precautions necessary to prevent catching the virus. They might have to charge a lot more for their services for all the protective gear they would have to wear.

      Insurance carriers should subrogate against the Feds for allowing these people through our airports, borders, etc. I know that’s far fetched, but they are not doing a thing to keep Eboly (that’s what the pres calls it) from spreading.

        Seriously? The Coast Guard is checking boats off shore. Visitors from those areas are having their tempatures taken before and after landing. Medical facilities have been set up at key international airports. Just what more, besides closing the borders all together, would you expect them to be doing?

            Perplexed, We shouldn’t be sending any more people over to Africa in the affected areas and certainly not letting any citizens of African nations into ours until this crisis has been contained. I think we will end up getting a lot of our soldiers infected before all is said and done.

            Perplexed, we have reason to be encouraged. The President cancelled two fundraisers to have a meeting at the White House about what to do about Ebola. No telling what the next spin will be about, but I am skeptical these people know what they are talking about.

          Libby, according to CNN, we are only setting up medical facilities at 5 airports. Where are you getting your information? Only five? Is that because nobody lands anywhere else in the USA?     Agent,I wonder how they would know what equipment to buy. I am not sure that I would trust the CDC to provide that information. Their track record is not too good.

      Seems like the people with the hazardous waste suits would have to get the body to the funeral home or crematory themselves and insert the body into the crematory themselves unless they are wrapping the bodies in a hazardous waste bag and no one else is going to be exposed.

      Probably not Crain. I saw a story the other night on local news that the Army/Navy Surplus store sales are booming with people buying all kinds of masks, respirators and plastic suits. People are very worried about Ebola and it seems our government is just inviting people in to the country.

      Perhaps some education on the contraction of the disease would ease people’s fear factor. The virus is transferred through bodily fluids (blood, vomit, sweat, urine, etc.) A gown, mask and gloves are adequate for equipment. The reason it’s spreading so fast in other countries is because they don’t have the protective gear available to them like we do. You can not get the virus just breathing the same air as the infected person. Please be cautious, but relax. It’s not like it is in the movies.

          draetish, I saw an interview with an infectious disease doctor the other night and he said we may have misjudged and it appears Ebola is spread easier than they first thought.

            I don’t usually agree with you Agent, but in this case I do. This virus is not the same as the 1970’s Ebola and appears to be more transmissible, based on people contracting it despite following the protocols. Maybe it has mutated, or maybe it has been bioengineered. In any case I don’t think the CDC is doing a very good job and I’m losing confidence in that agency.

            Not doing a good job? TWO cases in the U.S. I’d say that’s a pretty damn good job.

            Where are you getting your information that this is a more virulent strain? That’s not the case at all. Ebola in the 1970’s was more contained because people were less mobile then and the virus was contained in the villages in which it was contracted.

            It’s spreading because people in third-world countries don’t have access to protective equipment the same way we do in the U.S.

    Ebola is spread by body fluids incl sputum. Think about how much moisture comes in & out w/every breath…our protective gloves were est to leak anywhere from 4-50% of the time due to manufacturing process errors. If I’m a West African who can get out, the piddly screening at 5 airports isn’t going to stop me -I’ll fly east and land in LA or Seattle or Mumbai or Tokyo, spreading little virus particles all along the path. At roughly $1,000/minute, this is more costly than a set of quints. And the feds dithering on this doesn’t help (then again, lack of leadership hasn’t been this administration’s problem, on anything, only finding enough scapegoats. Blaming the nurses for catching it is like blaming the farmer for why a crop isn’t growing in a drought.

But the first thing you should know is that it’s not very contagious — “Common sense and observation tell us that spread of the virus via coughing or sneezing is rare, if it happens at all,” the World Health Organization says. It’s spread through frequent contact with bodily fluids and can be spread only by someone who is showing symptoms.

      “This is not an airborne transmission,” said Dr. Marty Cetron, director of the CDC’s Division of Global Migration and Quarantine. “There needs to be direct contact frequently with body fluids or blood.”

            Libby needs to check with an expert. If one starts with the preposition that contact with bodily fluid is the ONLY method of transmission, then one might be correct. But direct contact is the PRESUMED or KNOWN transmission method. No doctor will ever say that it’s the ONLY transmission method.

          InsGuy – yes. Because, if I had a child, I wouldn’t be taking them to Liberia, Guinea, or Sierra Leone. Neither my child nor I know anyone that has been exposed to the Ebola virus nor have we been exposed. So, yeah, I feel pretty comfortable in my current surroundings that I, and my child if I had one, will not be contracting Ebola.

    I am going to stay on issue here and not get into politics (poly-ticks = many blood suckers? sorry could not resist).

    I think it would be almost impossible for a health care workers, ambulance, flight attendant, funeral, or anyone who has come in contact with someone with ebola while doing job duties to NOT be covered for Workers compensation–and therefore exclusive remedy. If it was someone who came in contact while not working, even if it was a nurse, it would not be AOE/COE.
