Hurricane Irma’s ‘Last Gasp’: 3-Year Claims Deadline Put to the Test

    With all due respect to Barry Gilway, 627.70132 Notice of Windstorm or Hurricane Claim sets the deadline at 3 years from the date of landfall. Landfall for Irma in Florida was September 10, 2017 so the 3 years ended today, September 10, 2020.

    3 years is a ridiculous time frame anyway and it makes it impossible to predict costs and establish rate. The legislature needs to revisit this and make the time frame 1 year. If they wish to allow a longer time to file, claims presented after the 1 year limit should be allowed to be paid at ACV.

    There is no way possible that a person’s house was damaged by a hurricane 3 years ago and they did not know about it. IF a roof was damaged, you would know when the rain is coming in the next time it rained.

    Of course, nothing will change because the trial bar owns the Florida Legislature.
