What a concept. I wonder if I could sue VW, or Ford, or Chevy if I buy a car and I don’t like it after I use it for a while and I try to sell it and it is no longer worth what the dealer sold it to me for?
Toyota’s been drowning for years now. They lied in Japan and got sued by the government on not issuing recalls there. So people think this is new? It’s not. Toyota is a poor company with real problems that have been there for a very long time.
In the fall of 2004 I purchased a 2005 Chevy Tahoe Z-71, loaded. 2,000 miles later it was totaled in a crash. My settlement was such that I was unable to puchase the same vehicle. Such is life. You lose at least 10% once the tail lights exit the driveway.
A problematic side-effect here, if suits like this win, is they start to set precident for “Diminished Valule” claims against insurance companies when, although the vehicle was repaired to OEM specs, because CarFax says the car was in an accident the perception becomes that the car is worth less.
Right now only 4 states (that I know of) have Diminished Value laws, these Toyota suits start winning it’ll only be a few months before some ambulance chaser realizes the gold mine he’s got.
What people seeem to forget is a vehicle loses value no matter what! If you go to sell or trade in of course it is worth less. A hoops example of this is why is your vehicle worth less after it is paid off? Hhmmm

Many auto policies will replace the first year without depreciation or very little depreciation. I would look for new company / agent.
