There is no way a transgender employee and a Baptist University are going to see eye to eye on this issue; neither will their attorneys. My personal opinion is that the University had the right to terminate the employment, for a number of reasons, including misrepresentation.
Huh! I believe He/She was a student not employee, not that it makes any difference with your thoughts. I agree, there was misrepresentation on the application. Just because you identify one way or the other doesn’t make you that gender. Furthermore, what about the rights of the University as a religous institution…oh yeah, I forgot they have no rights anymore
He or She was expelled from being a student. But I agree that there was still misrepresentation. Which locker room was he/she using for gym class? What about the dorm if one was involved? And this is a religious university. They have rights and beliefs to follow.
Female::Male, Birth certificate::No Birth Certificate. Females are eligible and fall under different admission rules than Males. It may have been advantageous for her to enroll as a female as opposed to as male. Therefore lying on the application is material. The University did not undertake any overt action to test her application until she went public (for pay) with information that she had lied. At what point does the court stand up for standards that are appropriate. Throw the case out and charge attornies with court costs for frivolous lawsuit.

I agree with Brookie, she should have known revealing her transgender status on MTV would be an issue for the school. I wouldn’t be surprised if some type of reality show happens, either.
I don’t know much about CA law, but in my state as long as the school doesn’t receive federal funding, they can expel and deny admission to anyone who doesn’t conform to the school’s religious teaching. I’d like to know how this ends, whatever that is.
