I hope this is not just me….. the affirmative defense can protect the local and state goverment for “unsafe roads” as long as signage is used to warn motorist. So far it sounds reasonable. But the state is still on the hook for a 2007 accident because no warning sign that there was no medium fence? Motorist will be in accidents from reading all of the signs
