I quote here from your letterhead of my after care instructions received on 01-13-98 where I was seen after an auto mishap. (Did I mention? Yes, I did……..I wanted to be transported to VMC, because they had extensive history of my medical conditions but, was denied, going one-way ambulance Ms. Kegley) Ok, the quote here goes: “Your treatment in the emergency room is for temporary care only; establish appropriate follow up care as soon as possible” Straight I did, with that in mind, to my neurologist at Valley Medical Center in Santa Clara county. All I had to offer the neurologist was my mention of adding insult to injury regarding the auto accident mishap. With confirmation of a normal cervical x-ray serious noting “no fractures” of the vertebra by the person who did the x-rays, thus ensuring me of no additional injuries to report. Now, what I am questioning and would like confirmations of is the mention of mild C3-4 subluxation that is documented in the emergency department record and NOT in the department of radiology record? Knowing all the informatin provided to Los Gatos, Community Hospital of patient provider’s of my current status of health history and mentioning of physical therapy to begin soon. You would think that my order to receive proper continuing medical care at the treating facility (VMC) would include relevant disclosures of any medical records, radiology films, reports for establishing the correct physical therapy approah too. But, because there was some communicatin problems between your radiology department and emergency department, the hospital jeopardized my rights as a patient. And if that wasn’t enough, you people can’t even give me the diagnosis on the 8-22-98 radiology studies (had to read that too at a later date off medical records) or even locate the films of this date. This is an expierence I received also at Good Samaitan Hospital and the way I feel is: screw me for not being wise enough to believe “if it can happen once”, it can happen more that once!!” Watch out any patient and retrieve your records on the spot or you may find yourself backtracking and asking for an explanation? And forget about relaying any reliable records on time to your treating physicians, could take years. Please locate 08-22-98 radiology films, as I need them to take with me to VMC for an appointment. How does red-light runner with no braking, sound more like it. 08/04/95, spine cervical comp 4+views Findings: normal lordosis of the cervical spine. There is no bony fracture or joint dislocation. No prevertebral soft tissue or joint dislocation. No prevertebral soft tissue swelling. Odontoid intact. Neural foramina are patent on bilateral oblique views. Mar 18 2003 4:16PM, SP C-SPINE LIMITED+FLEX/EXT, FINDINGS: Degenerative spurring at C5 and C6. Slight disk-space narrowing at this level. Some posterior spurring suggested at the C4 level. Degenerative changes of facet joints. There is disk-space narrowing at C5 with anterior as well as posterior spurring. Degenerative changes over the joints of Luschka. Slight scoliosis. On flexion and extension views, only minimal offset is noted. I suspect that this is on a degenerative basis. CONCLUSION: Degenerative change (as described), especially at C5-6. So State Farm, that auto mishap: Damn Flu symptons

What I do not understand was the nasty mode of our (1) on (1) live conversation when I requested copies of my file regarding the above claim…..cannot see the sacrifice on your part to provide me with the information, instead you demanded that I correspond with a written request for the documentation copies of my entire file. Please note that Mr. Daniel Herns & myself no longer have a contract for legal services…..he gave up that when his interest in the case was subjective for his benefit. Mr. Herns was aware of my position of obtaining an attorney who would also be able to provide services for a Worker’s Compensation Claim that I had filed in 1996 and Mr. Hearns had boastfully acknowledged that he knew A-Z of Worker’s Compensation…What that means to me now is completely absolute nothing to ZERO!! What is your take on that? My request here is that you send me my entire file copies of the auto accident claim for which you are in possession of and to which at this time and to last indefinitely, are you to disclose any of personal medical file of the claim and other previous claim to any other source with out my permission including any subpoena’s of such records.
