Flipping people off may be crude but it is protected speech under First Amendment.

The ACLU has argued cases involving drivers flipping each other off. Courts have ruled that it is protected speech.

As for “obscene”, that word has specific legal meaning and gestures would not be considered obscene.

This bill must be sponsored by Repukes, they are always trying to make the government tell us what to do. Repukes love big government, deficit spending and spying on you in your own home.

Besides, you would have to arrest half the drivers in Boston if you made flipping the bird illegal.

    Stupid Repuke legislators.

seeing tailgaters get a year behind bars.
Driving is a privelege, not a right; if you can’t stay in control of your vehicle and your emotions 100% of the time you should never, ever be driving.

Does that rule out sidewinder missles I have on my truck?

I think you should take another look at who wants the government to take more control of our lives by handing out money for those who won’t help themselves, and fund everything from diapers to toiletpaper –its not the republicans.

This won’t work. Who will be monitoring these road rage incidents? What if someone cuts you off and the cop doesn’t see that, but the cop does see you respond by tailgating that person? You get 2.5 years in jail and the other guy gets nothing? There is no way to accurately monitor this on the roads. Dumb idea.

As someone who drives in MA, I’ve seen two cases of road rage that resulted in the two drivers having actual fist fights in the breakdown lane! Extreme cases I’m sure but I can’t wait to get back to NH after seeing that.

I just don’t see how making an obscene gesture is the same as committing a real crime. This is too close to trying to read people’s minds as to their intent. I honk my horn and get upset at stupid drivers occasionally, now I need to go to jail because of this? I certainly am glad I don’t ever go to this state.

Is driving drunk off of a bridge and leaving your passenger to drown considered reckless driving?

El Squid, your comment may have been funny about 30 years ago but now it’s tired, boring and completely unfunny. Can’t you come up with anything relevant?

Nancy, my comment wasn’t meant to be funny. I’m deadly serious.

It is really sad that the meddling morons who pretend to promote traffic safety are more intersted in collecting revenue than saving lives.

Elitists like Ted Kennedy and what’s his name the governor of New Jersey are exempt from punishment for the most blatant and dangerous behavior you can imagine while flipping somebody off is practically a capital offense. I’m glad I don’t live anywhere near New England.
