N.Y. County to Contractors: Prove Workers Are in U.S. Legally

    So now these contractors are guilty until proven innocent? I’m certainly against them employing illegals, but this doesn’t sound constitutional to me.

    this really is not difficult to do and it’s already supposed to be occurring. Employers have to fill out I-9 forms on every new employee and that asks the question about being legal to work in the country. You are supposed to provide some kind of proof, if you are from out of the country you just have to show a work permit.

    It sounds backwards, but all it’s requiring is an I-9 audit. Since the I-9 has to be kept in a separate file it should be fairly easy – pull the file and show it to whoever is doing the checking.

    Thanks for bringing that to my attention….the way the article states this above, if you didn’t know about it in detail, one would think that the law does! Great point, why just include contractors????

    I’m sure no one lies on when filling out their I-9. It is not as simple as pulling a file for review!!!

    No one is saying you are “guilty until proven innocent” about anything. Simply do the right thing as an employer, hire people that are legally able to work. It is backwards to have to go back and pull this info to begin with. If you provide the correct I-9 and documentation to in the first place than this is a non-issue. Almost any legislation like this at least is a step in the right direction. Not that hard to comprehend.

    If the problem is rooting out illegals, why apply it just to contractors? Why not root out all of the illegal landscapers, maids, nannys, lawyers, accountants, janitors and nuclear physicists and stand-up comics?

    By the way- and this may be wishful thinking- I hope one of you can pick up the sarcasm here.

    I fought this legislation from the begining so I thought I would add a little insight. First this was supported by big labor unions complaining about “leveling the playing field” unfortunately it is most likely going to be used as a method of harassment against non labor shops that are following the rules. A recent article in Newsday says the enforcement of the law will depend on “snitches” to call in and “spot checks” by the Suffolk Dept of Labor. Imagine a labor guy coming to your job site asking everybody for papers! Sounds like 1941 all over again So when I win a bid over a union shop what do you think is going to happen? Right I will be accused up the till about hiring illegal or off the books workers. It will cost me a lot of money to overwise prove that all my workers are in fact legal and certify my payroll. The law provides no penalty or reimbursement for those wrongfully accused. Just have a nice day!

    We should start with Homeland Security,they had a couple of illegal alliens working for them,they said the contractor that hired them didn’t check their paperwork properly.Then we should look at who is passing this legislation.Levy’s boytoy, of course most of us don’t look at the real problem here. Taxes are sky high ’cause of the school districts, nobody regulates them and our property taxes just keep going up.My question is if we deport all illegal alliens, is our tax burden going to be lessened by some divine intervention and gas and food prices cut in half? I’m all for it.

    It’s not backwards. As an employer you are supposed to hire only people who are legally allowed to work. Now here is legislation that will enforce this to happen. If you are “snitched” on then there’s a reason for the state to get involved. Just like if part of you plate matches or if you fit a description of a criminal the state has the right no has the responsibility to check you out. It doesn’t mean that you are guilty of anything until you are proven to be. And as for the guy who is non union worrying about the unions …well they can drop a line to OSHA or any other of numerous organizations’ to accomplish the task of making your life miserable. And the same goes for a lot of other areas such as CPS you can make an anonymous call and rat out anyone with a kid, just as the participants of any nasty child custody battle. This legislation only makes it hard on the people who are breaking the law that includes the illegals who are breaking the law just by being here. My question is why are we as citizens’ allowing these illegal’s here why are we not standing up????? We as a nation have allowed this to become such a problem and finally the Gov is doing something about it. Personally I think they should just put a 75% tax on money going south of the boarder do away with personal and property tax and increase the tax on all goods and services by an additional 15%. I bet if the illegal’s had to pay and had to keep their money here we would not have this problem any more. But for now stop your crying start doing the right thing and send a big thank you to our local officials who have at least made an attempt to do so.

    Any of you ever been to a non union job lately 1 out of every 5 should be sent home and most of these contractors fill the rest of their work force with kids
    we need to go after any thing we can to compete with these non union firms

    kevin what about all these years you did not pay comp, ss , state and fed tax while these illegals worked for you. i know the check is in the mail and so on . heres your answer,i paid all those taxes b.s.

    It’s about time our lawmakers stood up and did something that tries to correct and possibly control a terrible condition in the U.S.A. that was caused by lawmakers sitting on their butts and doing nothing for many many years.Maybe Washington will wake up and heed our call.If not,lets vote them out!!!

    Kevin, your comments are the exact reason this type legislation is needed. You should have proof that applicants are legal before extending a job offer. Certification of payroll is a no brainer if you’ve followed all rules from the beginning. As to union snitches, remember that is a 2 way street. I’d lay money you only have to refute their allegation a couple of times & they’ll quickly learn they’re fishing in a dry hole. This legislation may not be perfect – what legislation is? – but it is definite step in the right direction.
