it could be the developer since they used the fly ash. surely not dominion power, since they supplied the fly ash. but it could be the local government because they had to approve the development of the site. i bet that chesapeake will not have enough money for resolve this issue. might have to use fed superfund for hazmat. it’s going to take a long time to clean-up that mess. very costly since we are talking 18 holes, clubhouse and surrounding area.

    from a hamptonroads-dot-com article

“Fly ash is a powdery residue left from the burning of coal for electricity. It contains heavy metals such as arsenic, lead and mercury that can pose environmental threats through groundwater and air.”

“The City Council unanimously approved a conditional-use permit for the golf course in June 2001, after assurances by Dominion that there were no environmental concerns the council needed to be made aware of and that the project met all federal and state requirements.”

Is this the only place where they have ever buried fly-ash? I doubt it. This whole story points to the issue that government does a poor job regulating, and it would seem the resolution of the mess will not be in the near future.

Well then I guess this lawsuit may be ash-backwards…and a pain in the ash.

    (I had to say it……)

Fly Ash is used in concrete and added to soil to grow crops in the USA for decades with no ill effects to the environment. Other countries recycle 100% of their Fly Ash with no environmental damage. The EPA doe not list it was a hazardous material. Looks like someone is fly fishing for the Jack Pot.

    From Wikipedia:

    “[edit] Groundwater contamination
Since coal contains trace levels of arsenic, barium, beryllium, boron, cadmiium, chromium, thallium, selenium, molybdenum and mercury, its ash will continue to contain these traces and therefore cannot be dumped or stored where rainwater can leach the metals and move them to aquifers.[21]

Sounds like its OK for some uses, but definitely a concern for water sources. Have the plaintiff lobbies been trolling wikipedia?

I played there before. The joke is not to take a divot, but if you do, don’t touch it. I broke 80 there. Nice course.

As Matt posted, the City Council issued the permit, not the Feds. So how is this George Bush’s fault?

Although I am still trying to determine how I can blame Bush for the poor performance of my college football team.

CHesapeake is to blame. They will do anything for a buck. Look at the landfill overall by Dominion Blvd before the Elizabeth River. I live in Dominion Lakes and they were supposed to stop dumping there years ago. Every year it is addressed, they say how they are stopping, yet it continues to grow. There are so many people being paid to keep silent. CHesapeake is a mob organization. I wish someone form the Pilotwould look into that dump and sho is getting paid there. They can get a Pulitzer for sure. But it is about time someone stands up to the corruption in Chesapeake.
