Try to remember who the injured party is and who the suit was supposed to help. If there is any money available she should get the bulk of it. The attorney took this knowing what was available to pay any judgement.
Not true that the insurance company would not have paid without her getting an attorney. Assuming the at fault party had somewhat low limits, and the severity of the injuries, some insurance companies would just pay the limit. I am an agent and have seen this happen on occasion. In this case the plaintiff would have received 100% of the insurance money, but she would need an attorney to go after more, which may never come if the guy is in jail and has no assets, at least for a while. It may be tougher to get an attorney to represent her if she settled quickly with the insurance carrier since no immediate money would be available to the attorney.
Yep, its unlikely she’ll see any of that money. If any is forthcoming, you can bet the attorney will get his paws on it first.
