    Sadly, the boy wasn’t wearing a helmet which is required by Connecticut law. Wish the family would use this a trainable moment to let other children know of its importance.

    A skate park is neither designed nor inteded for bicycles. The kid made a big mistake and lost his life. The parents bear some responsibility for not insuring he had and used a helmet. Having said that, let’s see how long it takes for the parents to file suit in an effort to blame someone else. I can see the complaint now: “the defendant(s) negligently constructed a park knowing that someone would use it for other than its intended purpose. They should have posted signs warning of the dangers of falling off a bike while doing something a kid shouldn’t have been doing in the first place. They should also have posted warnings about the dangers of doing bicycle tricks without a helmet.”

    Maybe you should give the parents a chance to grieve a little mr. cynic? I doubt that is where their heads are right now. Just because the kid was not wearing a helmet does not mean the parents did not make it a rule. Kids break rules all the time. Nobody knows the facts yet.

    My parents tried to get me to wear a helmet when I was a kid. I rode around with it hanging on my handlebars. In fact, that’s exactly where my helmet was when I flipped over the bars and got a severe concussion. Anyway, my heart goes out to the parents who probably did everything right and still ended up suffering.

    Maybe it’s just being calloused from decades of claims handling, but I agree with Dan about the probability of a suit being filed when the shock and grief subside.

    Too many parents look to blame someone else for what happened. Few have the objectivity to call it an “accident”. A lawsuit helps channel their grief and guilt to someone else. And of course, it’s never about the money.

    Rest assured the family will use this as a trainable moment. They will sue the skate park owners, the bicycle manufacturer and anyone else the attorney can bring into the picture for $30,000,000. Then they will hold a press conference saying that they are not suing because of the money but because they want to bring about change and make sure this doesn’t happen to anyone else.

    To all whom are assuming a Helmet would of saved this boy! The answer would be NO..He broke his neck and bleed out due to a trachea crushing..so A helmet would of done nothing…The one thing is I would say is the Ramp is meant for Skateboards NOT BIKES….My Condolences to his parents..

    My thoughts on this as a parent make me feel tremendous sympathy to these grieving parents. Why are we so quick to judge another when we ourselves do not know how we would react if it were our child. This life which only had 13 years to give his family joy is now gone. Can’t we just leave our jaded comments about lawsuits etc out of this? And do not give me reality is what it is. These parents lost their son, and if it were me I would be so devastated and completely wretched with grief I would not be able to talk to anyone much less some attorney about suiing a skate park.
    Give it a rest people….a life was lost!

    Sorry Chris, but this is a site that deals with insurance, not the Oprah web site. The people here are used to seeing this type of situation go immediately to the courts with massive transfer of assets, but of course, it’s never about the money. There is nobody posting here who is unsympathetic to the parents. Anyone who has been in the business more than a few days has seen where these terrible accidents lead, straight to the courthouse. You want Dr. Phil, go to his website. This is for insurance professionals, (not always true) to post comments regarding insurance topics.

    I have to agree with the others that some of you are so quick to come to conclusions. Although our society has created some of this we still need to think things out before we say anything. Although one could jump to conclusion on what the parents may do let them make that decision after the greif and sorrow dwindel. Jumping to the conclusion that the parents will do something is also part of the problem. If we give them the idea they may run with it. However, this is where the lawyers step in. I would not be suprised if they are already trying to contact them. Anyway let time pass and the parents make whatever decision they feel appropriate and then comments could be said after more information is known.
