    Do personal injury claim awards affect Social Security Benefits? Isn’t it “an injury to the person” and not an injury to the system here? Bob, I’m sure you must know, but you’ve lost me with your explanation. Would you please clarify.

    The sister picks up a cool $750K (less the usual atty fees). What does that have to do with the abused person? That poor schmuck won’t see a dollar of that award. Since the real claimant can’t use money anyway, why does our legal system continue to reward un-injured relatives by paying them money. Sure, the incident is disgusting and the home and employee should be punished. But…….throwing money at relatives isn’t making anything better. They could just as easily have found some sort of punishment, financial or otherwise, that would have benefited the home care industry or some charity.

    The sister is the victim’s conservator. What the article left out is the facility has since closed. The victim has permanent internal damage from the alleged attacks and will need additional medical care. The money will go towards his future care; provided they can get it out of the plaintiff.

    Batten has been charged with five forcible sodomy counts, three carnal knowledge counts and one abuse and neglect count involving the victim that investigators say took place between late 2006 and mid-2007. He has a trial date in July. He also faces another carnal knowledge charge against another man.

    The worker and instituion’s management should be punished and a large monetary award is not necessarily a bad thing. I’ve worked with assisted living institutions and found that most mentally disabled adults are on medicaid and social security. This award should make him ineligle for these programs and if he lives long enough the tax payer, rather than the sister, will benefit.

    The lack of compassion shown by some of the posters on IJ is downright scary.

    ????, you need to sign on to the Oprah site if you want compassion. This is a site about insurance issues. Some OPINIONS stated on the site don’t seem compassionate? So what, it’s an opinion site. Free speech and all?

    I was thinking assets and contributions were factors in determining disability benefits before age 65, but I may be incorrect. Medicaid was asset and income based and as far as I know it still is. And I was advised recently by my attorney that although BI awards are generally non-taxable the proceeds can still be used to determine assets – but then I’m not an attorney or an accountant.
