I may be a stupid Insurance Agent, but I wonder what role Workers Compensation had in these workers claims. The last time I checked, it covers injuries and work related diseases suffered by workers. With these huge settlement numbers, it is almost as if NY had no coverage.
As we all know, Workers Comp is generally the exclusive remedy for work related injuries. The court must have made an exception in this case.
More important, are the workers’ lawyers getting about a quarter of a BILLION dollars in fees out of this while the plaintiffs get an average of $50K each? That’s assuming these vultures are only charging the minimum 33.3%. If they’re having to cut their fees, I bet it won’t be by much. I also wonder how many fraudulent claimants joined the legitimate ones in this class action.
You are right claimsguy. I am sure many of these claimants were not satisfied with open medical and want serious money. I would also venture to say many office workers within 5 miles of ground zero have filed claims for lung related disorders. NY is famous for getting hand outs from government at all levels.
I am wondering too Tyrone. We may as well pick up all those within 25 miles of ground zero because they breathed dust and smoke. I am sure there was a ton of claims filed on Workers Compensation, Group Health and Individual Health policies. Then, we have to file separately and have another big bite of taxpayer money going to the victims.

Why were all the Guardmen Responders dropped from the settlment and not allowed to file suit.I am one of those dropped.

How can National Guardsmen who ate just as much smoke as everyone else be included in the settlement.
