As I was reading the article I’m thinking to myself, what standing does the Paterno family have in this agreeement between the NCAA and Penn State? And then of course, that’s one of the reasons to have it thrown out.
If the family loses they should have to pay the legal fees of the other party. There has to be a downside to filling lawsuits of the insanity will continue.

Yes, I agree that some sort of “loser pays” scenario should be pursued, although it would be have to be done carefully. maybe just making it at the judge’s discretion would be a good start.
