A DUI (Driving Under the Influence) or a DWI (Driving While Intoxicated) legally means “driving a motor vehicle while impaired by alcohol or other drugs, including those prescribed by physicians.”
You can get arrested for a DUI for driving on, say, Oxycodone and Percosets but never having a sip of booze or a hit of weed that week.
When a state says “we arrested 40 people for DUI” they’re not just talking about drunk drivers, even if you don’t agree with how every state and law enforcement classifies a DUI/DWI.
So Rosenblatt, is there a breathalizer test for drugs when an officer stops someone and concludes he should issue a DUI/DWI citation? It is quite easy to smell alcohol and some of the idiot drivers have beer or a bottle of booze right next to them in the seat.
