Marshmallows are the worst! The softness just conforms to the throat and the body temp makes them so gooey, that the Heimlich maneuver does not do anything to dislodge them. I never gave them to my kids when they were small. But as they grow up, you just can’t protect them from everything. so sad.
How long have Marshmellows been around and this is the first case I have seen where someone has choked to death on one. They are very easy to chew and swallow. I guess I was lucky when we were at the campfire roasting them when I was a young kid.
marshmallows, bananas, hot dogs…the list can go on and on of items that are easy to get lodged in the throat. No amount of money will bring this girl back; it’s a difficult situation, hopefully there are many people praying the both sets of parents to bring them strength and peace.
Law suits and trial lawyers at their very worst. Unless something criminal transpired I can’t imagine how this lawsuit is going to comfort the parents. At 11 years of age, wouldn’t most kids recognize the signs of someone choking …..? But since they don’t have any assets I don’t guess we should sue them.
Practicing law 34 years. Is their anyone out there who even gets it? Where did values change in our society? Here is a clue for one to ponder. When prayer was taken out of the school systems is the period when morale changed! Just look back from early 1960’s to the present. I challenge anyone to tell our kids what the ACLU has done. They wouldn’t understand anyway, and my money is most American’s don’t either!
Maybe we should all lock ourselves in our homes, put up walls and never socialize with anyone for the feared of a trial attorney filing suit. I feel bad for the parents but I dont uundertand the lawsuit.
If there had been supervision, a 911 emergency call may have saved her life. Sorry, but I do see some liability on behalf of the adults throwing the party.
See the attached incident that occurred at an Illinois school district 15 years ago. This resulted in a multi million dollar award for the family. This girl was not a toddler either.
Very sad situation indeed. Just wonder how money will help these parents get past this tragic event?
Why weren’t her own parents there to supervise her?
Because they left her on the care of other adults throwing the party, obviously.

Sad, but it was not like she was a toddler. So who would think she would need to be supervised while eating them?
