Interestingly we too, a CT-based plan holder, had an Anthem BC & BS plan in place at the time the Anthem demutualized. Funny, at the time all of our employees were given individually the windfall in the form of shares in the company, and not the plan holder being given the shares based on the employee headcount. As a plan holder at the time, based on this ruling, can I now go and claw back the shares due my business, after all, since Governor Malloy has so thoroughly wrecked CT’s economy, I can really use that money to fill my company’s budget shortfall the same way the state did their employee’s share values.
