Do you REALLY believe the garbage men had an ulterior motive and thought “ooh, let’s have this train hit us. but we really need to sell it, so let’s make sure we BOTH get ejected from the vehicle when it gets hit.”?

The Albemarle County Police Department had received reports about the safety gates malfunctioning dating back to 2010.”
Pretty much proof the NTSB is about as corrupt as it gets. Magic
witnesses appear after 3 weeks–Video disappears for three weeks. No
mention of the skewed, humped, drop offs that would hang up Big Foot,
missing barriers around gate posts, why a uphill train would be going
61 mph in a 60 mph zone after seeing a big frickin truck across the
tracks for 10 seconds (1.46667×10 seconds truck clears)–interviews
with bus garage— Just look at gate–lights–street paint (feet out of
MUTCD standards) This even legal? Do any of them have a clue on how
signals DON’T WORK?

Further investigation needs to happen but it seems what everything is pointing to is that the warning malfunction often and give false warnings. The trash truck likely would routinely run into the problem more than most since its on the same schedule. Truck driver could have seen the warning but assumed its a malfunction similar to other times only this time it wasn’t. If common malfunction is proved there could be some liability.
However is this Garbage company has been delayed by false warnings in the past and took it upon themselves to ignore it instead of contacting the rail company or putting them on notice then comparative negligence applies. I doubt the garbage truck was trying to cause injury or get hit on purpose. Hopefully the full truths come out.
