    $350 large will buy a nice plastic bubble for this child to live in, and a nice car for his dad to drive him to school in.

    And maybe some walking / running lessons from the same gym teacher.

    He could have gotten those injuries from basketball. Would that generate a law suit?

      Sadly, it would. Handling some schools, frivolous lawsuits like these constantly arise.. Girl falls and bangs her head while playing basketball in a league.. Paid.. It gets ridiculous.

    If there had been kids hurt before they should have been playing this game outside on grass to limit their liability. That being said, it’s tag, none of the instructions say you have to run into a wall, there were at least 12-60 students that did not break their wrists playing this game. I had a friend give himself a concussion running after a ball in dodgeball bent over head first into a brick wall. His parents laughed it off.

    OK, the kid was not even pushed into the wall. He ran into it himself…what am I missing here? These types of lawsuits are what is wrong with our legal system. Don’t get me wrong, I feel sorry for him, but it wasn’t someone else’s fault.

    These are the same people that will raise He@* when their own insurance goes up because they never made a claim on their own policies!
    Hey, it is insurance companies money and they have lot of it!

    if this goes before a judge, I’d bet it would be tossed but get it before a jury and hold on to your pockets. But a judge would still have to approve any judgment…I’m betting this goes nowhere. Probably dad is the one pushing this. If my kid did that, and came home complaining, I’d tell him it was time for him to start using that thing on his shoulders for something other than a hat rack. as someone above said, I’d laugh this one off, even if he got a concussion. Some kids learn the hard way; let it go at that.
