Wis. Jury Rules Lead Paint Industry Not Cause of Boy’s Mental Retardation

    What an intelligent and fantastic jury and what a beautiful verdict. Hope all higher Courts quash an appeal in this matter. Case is a bunch of b.s.

    “That court found that plaintiffs did not have to prove that lead paint manufacturers had made the paint or the lead additive that caused the damage, but only that they could have. The Thomas case was the first where that decision had been applied.”

    So, you live in Wisconsin, have lead paint in your home, and have no idea where it came from or who manufactured it. You get the yellow pages out and look up paint companies, pick one at random and say that’s the one I’m going to sue. Or you get a lawyer to help you figure out which company has the deepest pockets. What the heck is that?
    Learn some other languages and get out while you still can. The toilet is getting full and the handle is about to be pushed.
    Zeeks that’s insanity. Imagine saying that a person didn’t have to know which driver damaged their car in a parking lot, that they could point to anyone and say that driver could have done it.

    Worse yet, in many cases they don’t allow you to argue that the child was not likely to have been a rocket scientist by looking at the genetics of the matter. They say “well, he only has an IQ of 70.” Why isn’t it relevant that Mom and Dad only have an IQ of 70 and that is ONE reason why they were living in the dump in 2000 that still had lead paint that they allowed their child to eat. I saw a story last night, one out of 3 children had seriously elevated lead levels. Blood transfusions, 2 months in the hospital and the levels are reduced. Two weeks home and they’re alarmingly high again. What is wrong with this picture?? The kid can’t still be eating paint chips, can she? Would any parent allow that? But if not, what is the source of the lead?
