maybe the lawmakers had too many too drink while writing up the law… with so many folks involved, they could not keep things straight but then of course, they were all drinking…

i agree, that penalty should be the same no matter which jurisdication it is. i agree w/the 3 strikes you’re done! or at least revoked for a great length of period. now, if that dui is including a veh manslaughter, that should automatically be a strike 3, even if the first due to the dramatic loss of life.

I think something more Draconian is called for considering this historical problem isn’t getting better. The only way to change behavior is to have a significan consequence. How’s this for starters:

1st offense: drunk school, 30-day license suspension (including to work,
    and a $2,5000 fine.

2nd offense: drunk school, 90-day license suspension (including to work), a $5,000 fine, and impoundment of the vehicle being driven (REGARDLESS OF WHO OWNS IT) for 180-days.

3rd offense: drunk school, 1 year license supsension, a $15,000 fine, and impoundment of the vehicle being driven (REGARDLESS OF WHO OWNS IT) for 6 months.

ANY at-fault offense involving a fatality – lifetime license revocation, criminal prosecution.

p.s. American society doesn’t have the balls to do anything substantive.
