An insurance company is suing the maker of a portable pool to try to recoup money paid out as a result of a collapsed pool at the Mitchell Aquatic Center in Mitchell, S.D.
The Mitchell Daily Republic reports Nautilus Insurance Co. filed an amended lawsuit against EZ Pool Products in Davison County. Nautilus is alleging negligence, strict liability and breach of warranty against EZ Pool Products.
The aquatic center ordered and received a portable swimming pool from EZ Pool Products in 2010 when it was no longer able to use the Mitchell School District pool after it closed.
The portable pool was assembled in February but collapsed after three weeks, flooding other businesses in the same plaza.
The insurance company is seeking $47,113.70.
