How much clearer does a notice of cancellation have to be than to give a date and an exact time of cancellation if you fail to pay the premium? That is pretty darned clear to me. Does it need extra wording, i.e honest, we really mean it, if you don’t pay XX at xx date/time we WILL cancel you, even if it is a Sunday? Anyone in insurance knows she got a renewal and a bill, then a notice of cancellation when that bill was a not paid.
This woman is where she needs to be, in jail.
I feel for the children who were hurt. I hope that this women is ordered to pay for the rest of her life (or until she pays what is owed) since she was uninsured. The court appears to have gotten it right this time though.
some info on the true severity of injury would have been nice, but the kids should be eligible for UM coverage within their own HH if they are a member of a family with a vehicle and insurance…since the driver was uninsured.
Odds are this was a very expensive month to month policy, wouldn’t be surprised to see the driving record was very poor…hence she missed a payment. Don’t feel sorry for her…hope the kids injuries were not too bad.
My prayers go out to the families of the children that were injured by this person. The courts go this one right. A Cancellation notice was mailed out to this person that her insurance coverage would be cancelled on the date indicated. All Cancellation notices are sent out with plenty of warning for the person to pay their premium for insurance. This person belongs in prison, and should begin to pay the families for their children’s injuries.

I didn’t see anything about a cancellation notice; just a renewal. Apparently, this insurer doesn’t allow a 10-day grace period.
The renewal was probably issued on a self-cancelling form as Alpha is a non-standard carrier. Don’t pay the renewal, no problem. Have a Happy Life, we assume you handled your insurance elsewhere.
As far as the renewal date being on a Sunday, what is wrong with paying it on Friday? Or Thursday? Let’s use some common sense!
Many companies offer a grace period at the renewal, but it only applies if you pay your premium. (This was established years ago due to mail time. By putting it in mail and postmarked on the 22nd you have effectively paid the premium) So if they receive the premium 2 days after the renewal date they will apply the premium to the full term with no lapse. Try and pay 11 days after and she has a lapse and no coverage for that 11 days. She didn’t pay.. no grace period..period.
I hope this is not changed. Underwriting and policy terms are factored into premiums charged but it would be immpossible to calculate a cost of a policy changed by the court after the claim.
