Zurich Says Its Policy for Sony Doesn’t Cover Data Breach

    If they had theft coverage.. I think Zurich should cover the loss… As always read the exclusions…….

    Wouldn’t coverage trigger due to Sony’s Error in securing the information improperly and the theft of said information?

    For GL coverage to apply, there has to be an occurrence that results in Bodily Injury, Property Damage, Personal or Advertising Injury as defined in the policy. Data Breach is not included in any of these definitions. (Property Damage has to be tangible property, not data.) I am amazed they did not have Cyber Risk coverage. Hopefully, their broker offered it to them, or an E&O claim will be coming. (An E&O claim will probably be filed even if they did offer the coverage.)
