It will be interesting to see whether the court will stick with the Constitution or side with the Progressive crowd who wants to do away with the Constitution as an outdated document which need to be changed. This is a seminal moment in this country on what direction it will go. There is no doubt in my mind that the law passed is unconstitutional mandating citizens buy a product or service under penalty of a fine or tax. If the law is kept, there may be a general uprising in this country.

The Constitution states that Congress has the power “To regulate Commerce with foreign Nations, and among the several States, and with the Indian Tribes.” That’s called the Commerce Clause. The Supreme Court has repeatedly stated that this means that Congress has “the power to regulate those activities having a substantial relation to interstate commerce.”

You seem to be hung up on the idea that Congress can’t force citizens to buy something. Why, in your opinion, does Congress have the power to prevent people from purchasing a product, but not the power to force people to purchase a product? What is the difference?

There is a big difference between regulating an industry (which they already do in the Health Industry) and ramming something like this down our throat under penalty of a fine or tax. The Founding Fathers were afraid of a big government like we have today which seeks to regulate every aspect of our lives. Apparently, you are part of the “Big Brother” crowd who likes having government intrusion into our lives. If they win on this issue, everything else citizens do will be closely monitored. This is not the country I grew up in and that is why the folks will rebel against it if the Supreme’s get it wrong.

You never answered the question. What’s the difference? You say there’s a big difference, but you don’t say what it is. Congress can regulate, I think we all agree on that. Why can’t the regulation be that you must buy a product? Where does the Consitution say Congress can regulate, but regulation doesn’t mean forcing you to buy something? Hint: It doesn’t say it anywhere. Regulation is a very braod term and can mean a whole host of things.

As far as Big Brother, you’re joking right? Republicans are the ones trying to force government into our bedrooms, trying to illegalize consensual relations between same-sex couples. Yes, illegalize. Republicans want to regulate what women do with their own bodies.

This law forces people to stop leeching off the rest of us. The law forces people to take personal responsibility.

You’re right, this isn’t the country you were born into. All that changed when George Bush ignored the memo he received a few weeks before 9/11 warning him that Al Qaeda planned to launch attacks against us using airplanes.

OPOV have you been looking up your information up on Wikipedia again? Bush received a memo? And even IF he did get such a memo, what in your opinion, Ms Know-It-All, would you have had him do to stop those planes? How do you know that he didn’t do anything? Oh, that’s right because you seem to know everything. I have also heard conspiracy theories that Bush had dinner with Bin Laden too before the attacks, which is also total rubbish. The American people do not want to be forced to purchase health insurance that they are not going to be able to afford. The Affordable Healthcare Act is nothing more then an oxymoron that is going to cost us taxpayers millions of dollars if it passes and I hope to goodness it doesn’t. It was shoved down our throats behind close doors because when Obama was out there promoting this monstrosity he couldn’t get enough Americans behind Hillary’s brainchild. That’s right. Hillary’s been sitting on this healthcare scheme since Bill was in office. We didn’t want it then and we most certainly do not want it now nor should we have to be threatened into purchasing it. Have you been listening to what is going on in Europe? The have socialized healthcare and they are going broke? We are already broke and you thing that socialized healthcare is going to make things better? Geese, what planet are you on?

As usual TOPOV, your views are highly unpopular on this blog with the dislikes running far ahead of the likes. You probably checied the like yourself so you would have a vote. If you don’t understand the difference between normal regulation that identifies abuses and what the Progressives are doing with this 2,700 page monstrocity, no amount of explaining will convince you.

I am so glad there is a person here supporting the progressive point of view. Unless the government can tell us what to do all those fat cats will continue to run things. I am so tired of hearing about the majority not liking this bill when the rest of us deserve to have health care. Health care, a living wage and home ownership are rights in the US not a priveledge. I work mt 40 hours and that is enough just because my coworker works harder and has a degree does not mean he should get special treatment. The government runs things better than any corporation, just look at the post office. I believe in our government and more power they have the safer I feel. The progressives are always out for our best interest and everyone should get out of their way, they know what they’re doing.

Careful being facetious here, 99. Too many people will think you are serious. Worst case scenerio is the “Saturday Night Fever” effect. It was a joke taken seriously and we all spent a decade in that horrid disco era with pants too tight, high heeled bubble toed shoes and shag hair-cuts. You can never tell what will happen when a joke is taked seriously so be careful….Don’t start a movement. I’d look terrible in a shag hair cut with my bald spot.

Dear Justices of the U.S. Supreme Court,

REPEAL this joke. What is next? Buy General Motors Products or pay a fine if you buy Mercedes?
Come on… Since when can the Federal Govt. mandate you purchase a consumer product?

Also, not all States mandate the financially responsible purchase of auto insurance!!! Until that common sense requirement is mandated, forget health insurance and ANY federal involvement.

Since when can’t the Federal Government mandate you purchase a consumer poroduct? Just because it hasn’t been done before doesn’t mean it’s not constitutional to do so. Congress can regulate. Period.

I’ll be laughing when even the conservative justices agree that this is Constiutional.

But my money is on the court saying the case isn’t ripe for adjudication because no one has been forced to do anything yet. My guess is that the court will punt and hope that there is a political resolution so that they don’t have to address it.

Perhaps we will have a Political Solution if the court punts. We will be looking forward to 1-20-13 for that to happen. The first order of business is to repeal this monstrocity and fire Kathleen Sebelius from HHS. The second order of business is to defund and disband EPA so they can do no more damage to business in this country.

This country is supposed to operate under the “rule of law”, not the “law of rules”. I can see that under the “law of rules” citizens are to be treated like high school students, with government officials (most likely unelected ones) playing the part of “teachers” who, at any moment, could send you to the “principals office” to be fined or punished for FAILING TO ACT [aha, topov, I think I’ve sniffed out the difference! maybe you could expound on how they’re the same?]
NEWSFLASH to the D.C. crowd, et al: I’m not in high school anymore.

The supposed test case for Socialized Medicine and model for Obamacare was Romneycare in Massachusetts. For those of you who care, read the new article out about how it is bankrupting the State. It is costing $600 million more this year than last despite enrolling more people. The Progressive solution is to raise taxes, but even at that, Patrick is contemplating scaling the program back because they just don’t have the money. Obamacare is Romneycare X 50. Folks, the money is just not there for the Utopian Prgressive dream.
