Court Rules Employers Must Reassign Disabled Workers to Vacant Jobs

    What about the able-bodied employee who is equally qualified for the vacant position? The ruling in favor of the disabled employee is not wholly equitable.

    The able-bodied employee can continue to enjoy his currently-employed position while the disabled employee, who is unable to work in his “current” position due to a disability, cannot just be simply “let go.”

    And, it keeps someone with a disability employed rather than placing an additional burden on the government.

    It’s not that hard.

    I must be reading this incorrectly. It sounds like before the ruling a disabled person could apply for any open position that they were qualified for and received preferential treatment if other candidates applied. Now it sounds like the employer can reassign that person where the employer wants him/her to go… That doesn’t sound like a win for the disabled. It sounds like their options have been stripped.

    And yet there is no such protection for employees who are disabled due to a work related injury.
