This article is confusing. National Vaccine Injury Compensation Program (VICP) for short is not as complicated as this article makes it out to be.
-The family of the vaccine injured submit a petition to the Department of Health and Human Services and if they oppose compensation the case is argued before a Special Master at the Vaccine court although it really isn’t a court. It’s an administrative procedure.
-A list of lawyers, who are private but attached to the Justice Dept. is given to the family. The family selects a Justice dept lawyer to represent them and the family ask the court/hearing to admit the vaccine caused the child harm and ask them to provide compensation. This is at tax payers expense. The lawyers are paid out of a fund from HHS. Fees to lawyers are routinely slashed and it’s not uncommon for a lawyer, even though attached to the Justice dept. to wait up to decade to be paid for a case.
-The pharmaceutical company is also provided with a lawyer from the Justice dept. This also is at tax payers expense.
FACTS:
-Pharmetutical companies do not have to participate at all in this proceeding and they don’t.
-Tax payers pay for the entire proceeding right down to damages if awarded.
-THERE IS NO DISCOVERY PROCESS. THE PHARMACEUTICAL COMPANIES HAD THIS WRITTEN INTO THE 1986 LAW THAT GIVES THEM BLANKET IMMUNITY. THIS WAY ANY (potential)INCRIMINATING DOCUMENTATION IS HIDDEN FROM THE FAMILY. Congress voted to give vaccine makers blanket immunity in 2002.
-Hearing are closed. No family, no reporters and no public.
-No judge and no jury. A special Master appointed by the US Court of Federal Claims presides over the hearing and issues a ruling.
-Legal presidents are limited so the court has issued over the years contradictory rulings considering one Special Master has no idea what another Special Master has ruled on.
-Special Masters since 1986 have awarded compensation for Autism caused by vaccines in 83 cases.
-HHS OWNS vaccine patents. Conflict of Interest because when the vaccines are purchased HHS earns a profit. So:

Now since 1989, and as of Jan. 2013; over 2.5 billion dollars have been paid out from this vaccine caused injury and death compensation fund. $2,550,640,666.73 is the current total figure paid out from this federal court system; which includes attorney fees, (paid out, win or lose the case). Since the first Vaccine Injury Compensation claims were made in 1989, 3,110 compensation payments have been made, $2,389,329,250.45 disbursed to petitioners and $94,604,103.72 paid to cover attorney’s fees and other legal costs.
As the parent of a severely vaccine injured who WON and was compensated millions by VICP 10years after injury , I say —- DISSOLVE THE VACCINE COURT. The government and the pharmaceutical industry have become way too cozy over this “unavoidably unsafe product” that they have no intention of making safer after 25years to do so.
