Being an older guy, I feel this kind of sucks.
On the one hand, I believe that a business should have the right to pick what they believe is the right candidate. In the case cited, the company probably was looking for a less experienced person who would be paid less than an experienced person and who could be around for 20 or 30 years and grow with the company.
On the other hand, why or how is age discrimination different from race discrimination?
Jack, what makes you think the younger guy will stick with the company for 20 or 30 years? Older employees are far more loyal, they come to work ontime, don’t smoke weed. Far better scenario than the younger employees.
Being an old codger, I can understand why the law shouldn’t apply to applicants. When employing a new employee, the employer is planning on having the employee for the long term and they don’t want to hire someone who is near the end of their work life and who will likely have more medical issues than a younger employee. Also, I had a lot more endurance and energy when I was 30 than when I was 60. I was able to get a lot more done in the same period of time. I could work cat. duty 12 hours per day, seven days per week when I was young but it became more and more difficult as I aged.
So they have confirmed that the only people that can be discriminated against when it comes to hiring are old white guys. Rather a strange decision coming from a bunch of (mostly) old white guys…albeit old white guys with jobs for life that will never have to worry about facing this issue.
Change facts of the case from age to race or sexual orientation and the decision is completely different.
As a 70 year old woman who is one month away from retiring from 33 years in insurance, I like to think someone out there will hire me a couple of days a week. I want to stay active and I also live in California which is not an inexpensive state in which to live. It will be tight living on just Social Security, so the extra income would be nice as well. I do not have a big fat 401k to fall back on. Thank you.
