    Where to start? I have a number or law firms that refer to me as their “legal research ” dept on arbitration issues. Why? Because they are too cheap to maintain a decent research/library staff. Too busy booking those billable hours. OK. Here in Texas, many law firms are requiring clients to sign a binding arbitration agreement as a requirement for representation. Absolutely enforceable. AND, if they designate the FAA as controlling, screw the Tx Gen Arbitration Act. AND, if the FAA controls, the terms of the agreement must be enforced AS WRITTEN. That means a limitation on damages is enforceable. So says the US Supreme Court. I’m not an attorney, but I can read and have more than 3 brain cells. Been following the development of arbitration since 1994. It IS settled law.
