Employers Warned of Potential Wage-and-Hour Claims Under New Overtime Rule

    Had a former client call with a question regarding this issue. He has 8 managers. 6 will be eligible for over-time, 2 will not. Their salary is too high. His questions was, what do I tell the 2 when they complain about no overtime? Simple, hand them a copy of the law and explain that they are ineligible because of government guidelines, which he cannot violate. Then, in a moment of brilliance, I offered that if they really wanted overtime, he could offer to cut their pay so as to make them eligible. He actually gave them that option. They declined. He is not worried about the overtime for the 6 eligible managers because he has instituted STRICT controls about overtime. “Good things happen when the govt gets involved” NOT.
