I agree with the decision, but not for the stated reason. If the TWIA cannot raise rates, which are supported by actuarial proof, then coverage limits should not be increased. Increased coverage, at inadequate rates, only leads to higher losses for the TWIA. I still don’t see where the Governor has the legal authority to suspend any provisions of the insurance code.
