So in practical terms, what will this bill mean for an insurer’s duty to defend in court? Will this leave the employee completely high and dry since their personal auto policy won’t defend them while driving a commercial vehicle, and now the commercial entity not being involved until the driver is found to be “negligent in operating an employer defendant’s commercial motor vehicle.” In practical terms, will the individual first being sued have a duty to be defended by any insurance company lawyers, either personal or commercial?
