Maybe I’m slow, but if Lafayette Co. wasn’t being overcharged and county employees were receiving the benefits contracted for, what restitution is due the county. I’m not defending these guys, I just don’t see the logic.
The problem is with the kickback given to the former county Supervisor, Gary Massey. A government official getting paid to select a specific contract is clearly illegal and unethical. The premiums should go strictly to coverage. The agent is entitled to a commission or fee as well for his services. The payment to Massey looks to be a bribe to me.
I agree that the kickback was illegal and they both were guilty of a crime. I just don’t understand what financial harm the county suffered that would entitle it to restitution.
I don’t see how the county overpaid. They would have been billed by the insurance company, based on their plan and census. The agent paid the kickbacks out of his commissions, which came from the insurance company, not the county.
The county may have overpaid as there were apparently no competing bids. They might have been able to secure the same coverage through another agent or company at a much better rate. Given the amount of the kickback, and since Agent Nowlin knew he had no competiton, I would guess he charged top dollar for the coverage and maybe even padded the commission/fee.
I must agree, ernie. The agent committed a criminal act but, there was not any net gain or loss for the county. The money exchanged criminally, came from legitimate premiums.
well i know mr nowlin has gone the extra mile to try to get out of this he has even made calls via telephone to a old chancery judge from pontotoc county charles thomas to get word to nowlins previous judge glen davidson to not give him any jail time but davidson has withdrawn himself from judging the case

The county should get back the amount it overpaid, i.e., the amount that went into the local politician’s pocket and not the insurance coverage.

well if massey got the supervisor position again in his re election bid they were going to repeat history and pull this again
