sounds to me like KMART is trying to make up for loss of use/income generated because of the sales. problem, the neighbor, kroger became apart of the development and the developer is the one that changed the landscape. now, if it was approved by the city, it does not belong to kroger’s responsibility. FEMA? heck no, because they are after the fact! suprised they did not go after the corp of engineers… kmart is going to be spending more money, instead of chalking this up to experience and know better next time.
