A divided Florida Supreme Court is letting a lawsuit go ahead against a company that runs a resort in Mexico.
The court ruled last Thursday that Shahla Cortez can proceed with her lawsuit against three Miami companies connected to the Moon Palace Golf and Spa Resort located in Cancun.
Cortez, a California resident, sued after she was allegedly sexually assaulted during a massage. She received the massage in exchange for her attendance at a timeshare presentation.
An appeals court previously ruled that as an out-of-state resident she was not entitled to file the lawsuit in Florida and should have filed it in Mexico.
But five state Supreme Court justices disagreed and said struck down the appeals court ruling. Two dissenting justices said that the appeals ruling should not have been heard.
