A federal judge has scheduled a hearing next week on Greyhound Bus Lines Inc.’s motion to throw out a lawsuit related to a 2008 accident in south Mississippi.
Megan Clancy sued Greyhound in Jackson County Circuit Court on July 6, 2011, saying she was injured in the accident on Interstate 10 near D’Iberville on Aug. 2, 2008. Megan Clancy’s case was moved to federal court in September 2011.
Her brother, Jon Clancy, also sued in Jackson County Circuit Court, where his case remained until a jury ruled in Greyhound’s favor last month.
Greyhound says that the claims in both suits are identical and the federal case should be dismissed because the arguments have already been tried in state court.
A hearing is Monday in U.S. District Court in Gulfport.
Megan Clancy’s original lawsuit said she was a passenger in a vehicle traveling west on I-10 when the driver slowed for traffic and the bus hit it from behind.
The suit said the accident caused “permanent personal injuries, pain and suffering, medical bills, anxiety, emotional distress and lost wages.”
