Mississippi Supreme Court to Decide If Damages Cap Is Constitutional

    Consider the actual case of a young, virile and very happily married man that lost his penis due to outrageous medical malpractice. CALCULATE that amount of damage, economic and/or non-economic, incurred while this young man now lives out the remainder of his life wondering if highly differentiated invasive sqaumous cell carcinoma will possibly return especially since he rejected advice to undergo even more drastic anatomical destruction to further reduce such a possibility. It is sad when such complicated public policy is allowed to be reduced by the insurance lobby to mere black and white while the world glows back at us in many shades of grey and, oh yes, even in color. We should let juries live to their fullest meaning as was intended so that they might address the real world in all its various shades. Genuine research does not support the general idea that juries are untrustworthy and appeals should hopefully correct the exceptions even in cases in which juries deny judgments that are factually deserved.
