If the employer completed the proper investigation and still chose to employ a worker without forcing the proper paperwork or didn’t bother to check at all, then I would agree that this decision is correct. Conversely, though, if the employee lied or used false information to obtain this job, I would have a different opinion.
Allowing illegal immigrants to claim the same benefits as legal immigrants and citizens does not seem right to me. Perhaps they should receive full benefits, but they — and their employers — ought to also pay the full penalty for violating our immigration laws.
If an employer chose to hire an undocumented worker and they don’t have to pay WC benefits (they probably never paid payroll on this employee anyway), then this is an incentive to hire more undocumented workers. The undocumented worker should still have recourse though the general liability policy. You cannot hire an undocumented worker and walk away from those workers being injured.
