“All lives matter” and this perp got what he deserved. Climbing through windows to rob someone or possibly murder someone is certainly grounds to shoot them. Hopefully, the lawyer bringing this will have to bear all court costs and pay a hefty fine.
Perfect example of our legal system that allows such frivolous lawsuits while the plaintiff simply has not accountability. I would like to say that the defendant (business owner so he has some money)could counter sue the mother for raising a no good lout with no respect for the law or his fellow man, but that obviously, once again, benefits the lawyers. Since we’re stuck with this contingency system that feeds the frivolous lawsuits, I would like to see a requirement where the plaintiff attorney has to sign on with his client and fork over legal costs of the defendant, since this one, like most, probably doesn’t have two cents to rub together.
I’m not sure about this particular venue, but some courts can mandate a bond be posted by the plaintiff re: owing court costs for the defendant should the lawsuit be dismissed or otherwise fail to meet the burden of proof.
The Deputy Coroner’s report included the following:
“It is the opinion of this investigator that Mr. Brown staged the scene and fabricated the prowler incident.” and
“Some type of event transpired at the residence that resulted in Mr. Brown killing the decedent without cause.”
I am not saying that it is a valid lawsuit, but you need a lot more information than what is in this article.
Wow Sandra, that article paints a whole new picture on this situation than what IJ reported. All this talk about the homeowner having the right to fatally shoot an intruder (while correct without the additional context your link provided) doesn’t apply at all to this situation!

He (KILLER) received four (4!) calls in less than a 10 minute span of him killing the “prowler”. He received a picture that day, of the “prowler” in the outfit he arrived in. They sent upwards of 50 text. My brothers and Mother identified a handsome young man, chopped down. In his nice clothing. No broken glass. No dirt. And one perfect bullet from a mortician.
A lot of things we are, our family. Business men and women. Law enforcement. Educators. Husbands. Fathers.
But not burglars. Not prowlers.

If the deceased person has a criminal record a mile long the judge should throw he lawsuit out. If the homeowners belongs to the NRA they will help defend the lawsuit.
All of the folks fleeing Syria were asked to give up their guns 10 years ago. They could not defend their homes or property against their own government. Now they lost their homes, family and lives.
Did you read the article that Sandra posted? There is quite a bit of evidence that gives the impression that the person was killed without cause. Regardless “if the deceased person has a criminal record a mile long” it is murder if the report is correct and “the decedent was voluntarily let into the residence”. So the NRA supports this type of activity…. Nice to know. And where.. anywhere in the article.. was there mention of giving up anyone’s right to own a weapon? Keep drinking the kool aid.
