What Uber should do is give drivers an option, employee or independent contractor. For employees, they get minimum wage, limited hours, employee rules and have to meet minimum criteria. For IC’s, the sky is the limit on what they can make and have more flexibility. There will be one or two token employee drivers and this will keep the division of labor at bay, if one really needs to be an employee, they have that option and no drama needed.

According to blogger who was quoted in the article, Uber drivers do not want to be considered employees. That is right up until the point that they are involved in a serious auto accident and realize that if they are “employees” and the injury was AOE/COE they could collect WC benefits.
