If he had been wearing Nikes, Nike would be the one being sued. The issues seem to be with the space in between the step and the side rails, not the shoes.

I would no sooner carry my 2 yr old on an escalator than I would prevent them from riding a bike, or learning how to navigate stairs, or let them feed themselves. C’mon helicopter parents! Hey Croc-a-Dial it back. Maybe it was the ups and downs of life. Getting kids to do what you want is like pulling teeth at a oral surgeon convention? Perhaps the shoemaker is false teethly accused?
Maybe there should be a requirement that children under the age of 18 may not ride escalators or elevators as they are too dangerous and adults sign a waiver before entering. Also, children must wear shoes of at least size 10 no matter the age.
