A San Jose, California-based electrical engineering and construction company paid $1.4 million for violating the Fair Labor Standards Act.
The U.S. Department of Labor found Cupertino Electric Inc. failed to pay proper overtime rates, fining and fined the company for back wages for more than 2,600 employees.
Investigators with the department’s Wage and Hour Division determined the company failed to include non-discretionary bonuses when determining the rate for purposes of calculating overtime pay.
Cupertino Electric has designed and built electrical systems for private and public sector clients in several states.
