    If they are here illegally, then they are being paid in cash “off the books”, which means the biz isn’t paying WC for them. So why should they get benefits?

      Jack, in Texas, illegal immigrants do not file WC claims. They are afraid of the consequences.

    In every state that has gone this route, they quickly learned that taking WC’s sole remedy away from injured workers leaves the employer open to the tort system.

    This was why WC laws were implemented across the states. Do you want to pay the statutory benefits of the state under WC or do you want a poor immigrant with injuries that could be catastrophic, or their heirs if the employee is deceased, going before a jury?

    It also serves as an incentive for companies to hire undocumented workers instead of Americans who need jobs.

      Sue, flawed reasoning. An illegal is here because he broke our laws. Need to stop with the “rights” argument. Illegals should not have the rights of citizens. Here legally by work permit, fine, swim the river illegally, not so much.

    I don’t think this is the best idea. It was my understanding that workers comp is paid for (or at least was designed to be paid for) by marginally increased prices across all goods and services since companies pay WC premiums from their bottom line. If illegal immigrants are consuming goods and services here in America they are effectively paying into that system aren’t they?

    Additionally, and this one is more of an opinion, it is probably better for American businesses to have access to cheap labor and have to pay out for it a little bit than to have a bunch of illegal immigrants permanently out of work due to underattended injury.
