In this day and age of cell phones with cameras running rampant, snapping pictures of everyone and everything, how can you legislate this? Will it be okay to take a picture and distribute it while the person with the sucking chest wound is still alive? Our government should have better things to do than make a law for isolated instances.
While I might not agree with the descriptive nature of your comment I do agree with the theme. We can not create legislation for every wrong act committed. This was very poor judgement and a despicable act done by one person. It is not a new crime wave, or a massive new tort situation. One person’s bad actions should not require a legistative response.
I agree we don’t need legition, but it’s more than poor judgement, it’s unethical. Ethics is a gray area for many, but clearly this was not within the bounds of proper behavior.

But, what are the damages to the plaintiffs? This is a money grab.
Money grab, or not. The courts have to punish guilty parties in order for them to change their behavior.
