    Well since Sullivan can’t seem to comprehend, here’s an example:

    A professionsl baseball pitcher’s hand surgery is botched. He will never pitch again. He is awarded multi millions in damages because of his lost earnings. He would probably get 250k pain and suffering, too.

    A child’s surgery is botched and he’s made blind. He can still work and other services for the blind are free, so all he’s entitled to sure for is the pain and suffering of having to live the rest of his life in darkness. This is worth $250k, however that amount is too low of effectively take the case to trial, so he gets nothing.

    Examples like this happen all the time, but the proponents of MICRA play dumb and hope we buy their phony concern for injured patients.

    Well, for one thing, a dead child or low wage earner has no economic damages. A low earner also has little economic damages. And how nice of them to say your medical bills are covered! saySince the cap hasn’t been changed in almost 40 years, many cases aren’t worth pursuing because of the cost involved.

    The above comments are clearly automated or by a hired individual and are completely ridiculous. I just come from a state that has absolutely no control over malpractice and I can tell you it’s a disaster, an absolutely disaster, for the patients and for the doctors. The only people winning are the lawyers.

      Automated and ridiculous? What part isn’t true? You do realize that MICRA elimates the collateral source rule which allows other sources of income (insurance, taxpayer supported services) to offset any judgment?

      No, sorry to inform you that Scott is really my name. I’m not an attorney, but I have a family member who was seriously and permanently harmed by malpractice and even won his case in court, only to see 2/3 of his judgment reduced by MICRA.

      I can’t begin to tell you of how many times I’ve had parents of dead children call me asking what they can do since no one will accept their case because of this law.

      How I wish I could give an automated reply. It would be so much easier.

    Look no further. Consider the source “Insurance Journal”. Vomit out of their mouths. The top executives,Hal Dasinger of Doctors Company ( above statement) and the other top executives make SIX figures, at least and the CEO makes SEVEN figures. Lisa Maas From CAPP makes $200,000 annually. These set of representatives of the BIg Business, Big Insurance are paid Big Bucks to say what they are saying. It is all BS. Tell it to a mother who lost her child to medmalpractice. She does not get economic costs, or any costs. The mother is left only with the pain, suffering and loss. So Mr. Sullivan, you tell me why the Micra cap of $250,000 would matter to the life of this mother. Tell me. I will tell you because I am that mother.
