There has to be more to this story, as in, how does BNSF know this bar “coerced” this woman into drinking an overabundance of alcohol before stealing a company truck. And what are they trying to collect, exactly? The price of a new truck or additional damages?

If I were this bar, I would counter sue due to the fact that BNSF’s employees were negligent in allowing this woman to steal one of their company vehicles while they were in her presence.

BNSF employees were not able to prevent an inebriated person from entering one their vehicles? BNSF employees were not able to call security or police? Is it acceptable behavior on the part of BNSF employees to allow potential endangerment of others? Surely BNSF does not feel they don’t in some way share responsibility with Casey’s and the woman herself in what happened? If they had prevented her from getting into the vehicle, perhaps sought security assistance, perhaps not made keys available they would no doubt be heroes – but since they didn’t, they’re taking the road to martyrdom? What a sad world we live in.

Prevention of losses might be in order here. Why were the keys left in the ignition on this truck. I doubt a drunk woman would be able to hot wire it to steal it. There is no case here and the railroad have dufuses working for them.
