Following a guilty plea, Nevada District Judge Steven Kosach sentenced Dennis Dean Hogue to 12 to 34 months in the Nevada State Prison for one count of workers’ comp claimant fraud.
Hogue was also ordered to make restitution of $9,500 to the Employers Insurance Company of Nevada and to reimburse the Nevada Department of Justice’s Workers’ Compensation Fraud Unit $2,500 in investigative costs. Hogue was further ordered to pay $257 in extradition costs to the State of Nevada Extradition Unit.
On Feb. 26, 2003 the Nevada Attorney General’s office received a complaint from the Employers Insurance Company of Nevada. Hogue was suspected of filing a fraudulent workers’ comp claim. The defendant had filed a claim in August of 2002 asserting that a fall and injuries occurred at work.
Hogue reportedly withheld information on several occasions that he had incurred injuries in the past. A previous claim undisclosed by Hogue resulted in a permanent partial disability payment.
Despite the obligation to do so, Hogue allegedly failed to inform his employer, insurer or medical service providers of this and other previous claims.
