A Travis County, Texas grand jury indicted Texas Home Exteriors Inc. and its vice president Derek Baker for falsifying a workers’ compensation claim to Texas Mutual Insurance Company—a third-degree felony. Texas Mutual (SM) investigator Sandra Milburn stated that Baker reported an injured worker as a covered employee under the company’s workers’ comp policy. Further scrutiny revealed that the injured worker was not a covered Texas Home Exteriors employee. Because the injured worker was employed by an uninsured independent contractor, the injured worker was not legally entitled to workers’ comp benefits. Donna Crosby is the assistant district attorney handling the Texas Home Exteriors case.
