New York Superintendent of Insurance Gregory Serio announced the arrest of Linda Ellis of Elmira, N.Y. on a charges of violating the Workers’ Compensation Law, committing fraudulent practice, offering a false instrument for filing, and perjury.
Ellis allegedly defrauded her insurance carrier by sending sworn statements to the New York State Insurance Fund to support her claim for lost wages, saying she could no longer work. The investigation revealed that these statements contained false and misleading information because she was actively employed as an Adult Personal Care Technician at an adult home in Pennsylvania. The investigation also revealed that Ellis had provided false sworn testimony at her Workers’ Compensation Board Hearing to support these false statements.
Ellis was arrested Dec. 9 and released on her own recognizance to appear at a later date in the Elmira City Court. The arrest is the result of a joint investigation conducted by the Insurance Department’s Frauds Bureau and the New York State Insurance Fund Division Of Confidential Investigations. If convicted of these charges she faces up to seven years in state prison.
